In short
- Stuntpony is a business tool. The customer is the company whose sales team uses it, and the person who signs up must be allowed to act for that company.
- It is in beta. Features change, prompts can be wrong, and there is no uptime promise yet.
- Your company owns its call data. We only process it to run the Service and never train models on it.
- Your company is responsible for telling call participants that an AI assistant is transcribing, and for not using Stuntpony where that is not allowed.
- Either side can end the agreement with 30 days' notice. We delete your data within 30 days after that.
- Belgian law applies. Disputes go to the courts of Ghent after a good-faith attempt to settle.
01The agreement and who it is between
These terms are a contract between Moscos BV, trading as Stuntpony, Haspelstraat 23, 9000 Gent, Belgium, company number 0774.733.555, VAT BE 0774.733.555 (“Stuntpony”, “we”) and the company on whose behalf you use the Service (the “Customer”, “you”). By signing in, or by continuing to use Stuntpony after your company has accepted a pilot order, you confirm that you are authorised to bind the Customer to these terms.
Stuntpony is offered to businesses only. It is not offered to consumers, and consumer protection rules do not apply. A “Representative” is an individual who uses the Service through the Customer; “Call Data” has the meaning given in the privacy policy.
If your company has signed a pilot order or another written agreement with us, that document comes first where it differs from these terms. Our privacy policy explains how personal data is handled, and a data processing agreement, available on request, governs the call data we process on your behalf.
02The service
Stuntpony is a desktop application (macOS today) and web workspace that assists a sales Representative during a call with short live prompts and discovery tracking, and afterwards with a summary, a draft follow-up and a short review. Once the Customer turns it on, a summary of each call is posted automatically to a team channel of the Customer's choosing. How Call Data is processed is described in the privacy policy.
Stuntpony deliberately does not:
- make audio recordings of calls or keep audio;
- show call content to anyone other than the Representative on the call, except the team summaries the Customer turns on and what the Representative shares;
- report on, rank or score employees for their managers;
- replace a CRM, a call recorder or a compliance archive.
The service needs macOS (other platforms may follow), a signed-in Google or Microsoft work account, and the microphone and system audio permissions the app asks for.
03Beta status
Stuntpony is in private beta. That means:
- features may be added, changed or removed without notice;
- the Service may be interrupted for maintenance or because of a defect;
- prompts, transcripts, discovery tracking and drafts may be incomplete or wrong;
- we do not commit to any service level or support response time unless a pilot order says so.
We will give reasonable notice of maintenance where we can, and we will tell you before we withdraw a feature your team depends on.
04Accounts and seats
- Each Representative signs in with their own Google or Microsoft work account. Seats are personal and may not be shared.
- The Customer is responsible for what its users do with the Service and for keeping their devices and accounts secure.
- The Customer must tell us promptly at hi@stuntpony.com if a user leaves or an account is compromised, so we can revoke access.
- We may suspend an account that breaks these terms, creates a security risk or is used to abuse the Service. We will explain why and restore access once the problem is fixed.
05Your responsibilities on calls
Stuntpony transcribes what everyone on a call says. The law on capturing conversations differs by country and by US state. Because you decide when and where the Service is used, you are responsible for using it lawfully:
- You will make sure your Representatives tell the other participants, at the start of each call, that an AI assistant is transcribing it for live notes, and you will keep a record of that disclosure where the law requires one. Where you already give a recording notice (for a call-recording tool), you may combine the two into a single announcement, provided it names the AI assistant and refers to your privacy notice; a notice that does not mention the assistant is not enough. Whether a combined announcement, or any particular wording, satisfies the law in a given country or US state is your decision as controller, taken with your own advisers.
- Where the law requires every participant's agreement (for example in Switzerland and in several US states), your Representatives will obtain it before starting a session or will not use Stuntpony on that call. Agreement given to another tool's recording notice does not count.
- You will give your Representatives and their call counterparts the privacy information the law requires of you as controller, and you will handle their requests about that data with our help.
- You will only connect integrations (calendar, Drive, Slack, your website) that your company allows, and you have the rights needed to let us process the data they expose.
You will compensate us for losses and third-party claims that arise because you or your users captured a conversation without the notice or agreement the law required, or connected data you had no right to share. This allocates risk between us. It does not remove anyone's obligations under criminal or data protection law.
06Acceptable use
You and your users will not:
- use Stuntpony to capture conversations where doing so is unlawful;
- reverse engineer, copy, resell, sublicense or benchmark the Service to build a competing product;
- probe, overload or interfere with the Service or its vendors, or bypass access controls;
- upload content you have no right to share, or use the Service to harass or deceive anyone;
- use the Service to make decisions about people that the law reserves to humans.
07Integrations and third-party services
Google, Microsoft, Slack and the other services a user connects are governed by their own terms and privacy policies. We access them only with the permissions the user grants, and only to provide the features described in the privacy policy. You can disconnect an integration in the app at any time and revoke our access in the provider's security settings. We are not responsible for changes those providers make to their services or APIs.
08Your data and our role
- You own your data. Call content, transcripts, coaching output, drafts, uploads and the content of connected systems (“Customer Data”, which includes Call Data as defined in the privacy policy) remain yours.
- We process it only for you. We use Customer Data to provide, secure and support the Service and for nothing else. We act as your processor under the GDPR; the data processing agreement sets out the details, including our subprocessors and how we notify you before adding one.
- No training. Neither we nor our vendors train AI models on Customer Data.
- Confidential. Customer Data is your confidential information. We disclose it only to the vendors that run the Service, under contract, or when the law compels us.
- Aggregate statistics. We may keep usage statistics that cannot identify your company, your users or anyone on a call, for example how often prompts are voted useful, to improve the product.
- Deletion. On request we delete a call and the output generated from it, or all Customer Data, within 30 days. Team summaries already posted to your team channel remain there under your control. On termination we delete Customer Data within 30 days, sooner on request.
09AI output
Transcripts, prompts, discovery tracking, summaries and drafts are generated automatically and may be inaccurate, incomplete or out of context. They are suggestions for the Representative, not advice from us, and create no assurance about a deal, a customer or a sales result. Representatives remain responsible for what they say, send and decide, and should review a draft before sending it.
10Intellectual property and feedback
We own the Stuntpony software, brand, prompt logic, scoring rules and everything we build, including improvements. You get a non-exclusive, non-transferable right to use the Service for your internal business during the term. Nothing here transfers ownership either way.
If you or your users give us feedback, suggestions or ideas, we may use them to improve the Service without any obligation to you and without naming you or your company.
We will not name you as a customer in public without your written consent.
11Fees
During the private beta the Service is free unless a pilot order says otherwise. Where a pilot order applies, its price, seat count, invoicing and payment terms govern. Prices exclude VAT. We will give at least 30 days' notice before introducing or changing fees.
12Confidentiality
Each side keeps the other's confidential information secret and uses it only for this agreement. For us that includes Customer Data. For you it includes the Service, its prompt logic, scoring rules and pricing. The obligation lasts three years after the agreement ends, and indefinitely for Customer Data. It does not cover information that is public, already known to the receiving side, independently developed, or that the law requires to be disclosed.
13Warranties and disclaimers
We will provide the Service with reasonable skill and care and in line with the privacy policy. Beyond that, and to the extent the law allows, the Service is provided as is, without any other warranty, express or implied. In particular we do not warrant that it will be uninterrupted or error-free, that transcripts or prompts will be accurate, or that using it will lead to any sales result.
14Liability
Neither side is liable to the other for indirect or consequential loss, including lost revenue, lost deals, lost profit or loss of goodwill.
Each side's total liability under this agreement is limited to the fees the Customer paid in the twelve months before the event giving rise to the claim, or EUR 1,000 if no fees were paid.
These limits do not apply to fraud or wilful misconduct, to death or personal injury, to a breach of confidentiality, to a breach of the data protection obligations in the data processing agreement, or to any liability that cannot be limited under Belgian law.
15Term and termination
- These terms apply from the first sign-in until the agreement ends. A pilot order runs for the period it states and does not renew automatically.
- Either side may end the agreement for convenience with 30 days' written notice. Fees already paid are not refunded, except that we refund unused months pro rata if we end the agreement without cause.
- Either side may end the agreement immediately if the other materially breaches it and does not fix the breach within 14 days of being told.
- On termination, access stops, integrations are disconnected, and Customer Data is deleted as described above. Sections on confidentiality, intellectual property, liability and governing law survive.
16Changes to these terms
We may update these terms as the product develops. For a material change we will email the Customer's contact at least 30 days before it takes effect, and you may end the agreement before that date if you do not accept it. The date at the top is the version in force. Minor clarifications take effect when posted.
17Governing law and disputes
Belgian law governs this agreement. Before going to court, the parties' senior contacts will try in good faith to resolve the dispute within 30 days. Failing that, the courts of Ghent have exclusive jurisdiction.
18General
- This agreement, any pilot order, the privacy policy and the data processing agreement form the whole agreement and replace earlier discussions.
- Neither side may assign this agreement without the other's consent, except to a successor of its business.
- Neither side is liable for delay caused by events outside its reasonable control.
- If a clause is invalid, the rest stays in force.
- Notices to us go to hi@stuntpony.com. Notices to you go to the email address of your account contact.
